This waiver applies upon service commencement, estimated Winter 2026. Pre-orders do not guarantee service availability or a specific date. Acknowledging this waiver at pre-order confirms your understanding of the associated risks.
The Vegas Karts experience uses the DF Goblin kit car platform — an open-wheel, mid-engine, street-legal vehicle built on a donor chassis. This is NOT a traditional go-kart or enclosed vehicle. It is an open-cockpit, purpose-built performance vehicle operated on public roads with regular traffic. Driving this vehicle involves significantly greater risk than a standard automobile or conventional go-kart.
Participants must be 18 years or older and hold a valid, unexpired driver's license from a U.S. state or Nevada-recognized jurisdiction. A valid license must be presented at time of participation. Inability to produce a valid license results in reservation forfeiture without refund.
You voluntarily assume all risks including: traffic and road hazards; vehicle mechanical failure or malfunction; collisions with vehicles, objects, or persons; weather conditions; loss of vehicle control; personal injury including serious injury or death; property damage; and all other risks inherent to operating open-wheel vehicles on public roads. No amount of instruction, supervision, or safety equipment eliminates these risks entirely.
You completely release Vegas Karts LLC, its members, officers, employees, agents, contractors, successors, and assigns from all liability, claims, demands, actions, and causes of action arising from any loss, damage, or injury — including death — resulting from participation, whether caused by the negligence of the released parties or otherwise.
You agree to indemnify, defend, and hold harmless the released parties from any claims, damages, losses, liabilities, costs, and expenses (including attorneys' fees) arising from: your participation in the Vegas Karts experience; breach of this agreement; violation of applicable law; or injury or damage to third parties or property resulting from vehicle operation.
You confirm you are in good physical health with no medical conditions or limitations preventing safe motor vehicle operation. You have full physical and cognitive capacity for open-wheel operation on public roads. You agree to disclose relevant health conditions to Vegas Karts staff prior to participation.
You agree not to operate any vehicle under the influence of alcohol, illegal drugs, impairing prescription medication, or any substance affecting performance. Vegas Karts may refuse participation to any impaired individual without refund.
Vehicles may be equipped with GPS tracking, telemetry, and cameras for safety, route compliance, and operational purposes. Collected data is used solely for operational safety and is not shared with third parties except as required by law.
You grant Vegas Karts LLC permission to capture, use, and publish photos, video, and other media of you during the experience for marketing, promotional, educational, and social media use without additional compensation. You waive the right to review or approve materials before use.
You agree to follow all Vegas Karts staff instructions, obey traffic laws, stay on designated routes, and operate the vehicle safely. Non-compliance results in immediate termination of participation without refund.
This agreement is governed by the laws of the State of Nevada. Any disputes shall be resolved in courts in Clark County, Nevada.
If any provision of this agreement is found invalid or unenforceable, the remaining provisions remain in full force and effect.
This document constitutes the entire agreement regarding assumption of risk and liability and supersedes all prior agreements or representations on the same subject.
YOU ARE ADVISED TO CONSULT WITH A LICENSED NEVADA ATTORNEY BEFORE SIGNING THIS WAIVER. BY PROCEEDING, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND VOLUNTARILY AGREE TO ALL TERMS OF THIS WAIVER AND ASSUMPTION OF RISK AGREEMENT.
Pursuant to the Nevada Electronic Transactions Act (NRS Chapter 719) and the federal E-SIGN Act, your electronic acceptance — whether by checkbox, button click, or digital signature — constitutes a legally binding signature with the same force and effect as a handwritten signature.
